Terms and conditions

1) This Preview Rendering engine and ordering system is automated. There will therefore be differences between the previews you are given and the ultimate block or panel you order and receive. The 3D Renderer will attempt to match colour, image trim and resolutions as closely as possible to what will be the ultimate product but differences are an inevitable trade off which allow these previews to be made available.

(a) This agreement places the obligation on the Client uploading images to Acrylic Photo Blocks (Seller) to obtain all necessary rights, model releases or consents required for image reproduction purposes. It is further acknowledged that the Seller gives no warranty or undertaking that any such rights, releases or consents are or will be obtained whether in relation to the use of names, people, trade marks, registered or copyright designs or works of art depicted in any picture. In the event that the picture is used or reproduced by or with the authority of the Client then the Client shall indemnify the Seller against any loss, damage, proceedings or costs where such rights, releases or consents have not been obtained.

(b) The client grants the Seller reproduction rights in respect of each images uploaded. These reproduction rights are offered by the Client exclusively for the purposes of producing the Acrylic Photo Block or Panel being purchased and for NO other purpose. The Seller and may not be re-assigned, nor may any picture submitted by the Client be loaned or transferred to third parties for any use whatsoever without written permission to that effect from the Client.

(c) The Client takes responsibility for requesting a final proof image prior to printing. Failure to request such will result in the seller attempting to match as far as possible the aspect ratio, colour reproduction and image size of supplied image. As a result Seller can in no way be held responsible for any discrepancies between submitted (original) image and reproduced image where no final proof image has been requested.

(d) With the exception of account customers, client accepts to pay the full retail price (inclusive of postage and packaging costs) prior to production commencing.

(e) Client accepts that Acrylic Photo Blocks can in no way be held responsible for any damage to items sustained once items have been lodged with courier/postal service.

(f) The Seller makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. The Seller will not be held responsible for any and all damages resulting from products and/or services it supplies. The Seller is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The Client agrees not to hold The Seller responsible for any such loss or damage. Any claim against The Seller shall be limited to the relevant fee(s) paid by the Client.

2. This agreement shall be subject to and constructed according to Australian law and the parties agree to accept the exclusive direction of the Courts of Australia.
